2 Background רקע The Animal Feed Production and Marketing Inspection Law or "Animal-Feed Law", was passed in February 2014 and published in the Reshumot. The Law is expected to come into effect in circa two years, during this period we are obliged to create a secondary legislation framework. In the meantime, supervision over production and marketing of animal feed is currently regulated by the Animal Feed Order (AFO), which has been in effect since Until the new law comes into effect, and during the period of establishing the secondary legislation, the Animal Feed Division will operate in accordance with the mandate specified in the new Animal Feed Law. In accordance to which, the responsibility, of both the safety and the quality of the product, lies on the producer or importer, and the state supervises the production, import and marketing, in accordance with the risk assessment policy. Article 2 of the Animal Feed Order deals with conditions for animal feed transactions, determining: "A person shall not perform transaction of a material used or which might be used for animal feeding unless it is animal feed, and unless per a written permit as for this purpose issued by the Director in accordance with the conditions of such permit" Therefore, Feed business operator (FBO) who produce and trade in animal feed must receive a permit to manufacture and trade in animal feed in the State of Israel. A Permit will only be issued if the FBO meets the requirements specified in the Animal Feed Order, and requirements specified therein, according to its line of business. Please find below updated requirements for issue/renewal of manufacturing, marketing and trade permits in animal feed products, according to the AFO and requirements for animal feed import permit, based on the Free Import Act 2012:, אושר החוק לפיקוח על מזון לבעלי חיים, התשע"ד בפברואר 2014 ופורסם ברשומות. החוק צפוי להיכנס לתוקף בעוד כשנתיים. בתקופה זו אנו נדרשים להתקין תקנות מכוח החוק. עד להתקנת התקנות החדשות, הפיקוח והאכיפה על הייצור והשיווק של מזון לבעלי חיים ימשיכו להיות מכוח צו הפיקוח על מצרכים ושירותים )ייצור מזון לבעלי חיים והסחר בו(, התשל"א- 1971, )להלן, צו המספוא(. עוד טרם כניסת החוק החדש לתוקף, ובמקביל לכתיבת התקנות, הפעילות של האגף לפיקוח על מזון לבעלי חיים, מושתת על העקרונות של החוק החדש. שלפיה האחריות, הן לבטיחות המוצר והן לאיכותו, מוטלת על היצרן, כאשר המדינה מפעילה פיקוח עליון על מנגנוני הייצור, היבוא והשיווק, ברמות משתנות בהתאם למדיניות ניהול סיכונים. סעיף 2 לצו המספוא עוסק בתנאים לביצוע עסקאות במספוא, ושם נקבע: "לא יבצע אדם עסקה בחומר המשמש או העשוי לשמש להזנת בעלי חיים אלא אם הוא מספוא ואלא לפי היתר בכתב שניתן לו לכך מאת המנהל ובהתאם לתנאי ההיתר..." לפיכך,, מחויבים יצרנים בקבלת במדינת ישראל. מפעלים וסוחרים היתר כתנאי לייצור המייצרים וסחר וסוחרים במזון לבעלי במספוא חיים ההיתר יינתן אך ורק אם יצרן, מפעל וסוחר ממלא אחר התנאים הקבועים בצו המספוא, ובדרישות המפורטות במסמך זה, בהתאם לתחום פעילותו. עדכון להלן במוצרי מספוא הדרישות צו לפי להנפקת/חידוש היתר ליצור שיווק וסחר המספוא, ודרישות מספוא לפי צו יבוא חופשי, התשע"ב הבהרות: ייבוא מוצרי לאישור ביצוע עסקאות במספוא ללא היתר, מהווה עבירה על צו המספוא. עמוד 2 מתוך 46

3 Clarifications: Transactions in animal feed without permit are a violation of the AFO. To avoid doubt, if a certain manufacturer or product's permit has not been renewed, it is forbidden to manufacture, use or trade in this product from the previous year's stock. Importing is not permitted prior to receiving the permit, as well. Some products belong to several categories; therefore additional documents may be required for the main category to which the product falls under in order to receive a permit. 4 Application 1. According to the AFO, a person may not conduct a transaction in animal feed without a permit issued by the Director of the Veterinary Service at the Ministry of Agriculture (MoA) or a person empowered by him. 2. Definition of "transaction" according to the Act: " any of the following actions made by a person not for the purpose of feeding the animals under his supervision or care" 2.1. The possession of feed or its transportation from the jurisdiction of one local authority to another, furthermore, offering of feed for sale or its display for sale Gaining ownership or possession of feed Transfer of ownership or possession of feed to another Manufacture. 3. Anyone carrying out a transaction in feed for feeding animal under his control or care is exempt from upholding the requirements herein. 4. The requirements herein apply to existing activities, new applicants and/or beginning of new actions taking place in approved plants. 5. The permit is valid up to one year from the date of issue. 6. The Director may determine a shorter permission period, based on the feed properties and type. 7. New applications or renewal applications during the calendar year will be submitted to the Animal Feed Division by post or by hand delivery. All documents and certificates required for examination must be attached to the application form according to the type of request. For further information, contact by mispo@moag.gov.il. 8. All attached documents will be originals or Certified copies. 9. All documents must be up to date, and issued during a period of maximum 6 months previous to the submission of the application. All analysis must be issued from ISO/IEC competent laboratories. 10. 5 12. Manufacturers' applications for a permit for Group VI in Section C and/or Section B of this document of requirements will receive a response within a period of 90 business days. 13. To ensure the fulfillment of the requirements and conditions of the permit, the inspectors of the Veterinary Services will conduct inspection and control checks over the permit holders. 14. Frequency and extent of supervision over FBO permit holders will be based on a supervision plan founded on risk survey management. 15. 6 Section A: Conditions for the issue of a permit to import raw material and/or feedstuff General conditions for importers In order to obtain an Importer permit, the following documents shall be presented: 1. Permit request application, Appendix 1 or 2, according to the type of product. 2. Statement signed by applicant regarding committing to AFO requirements, Appendix Submit a recall procedure, according to the guidelines in Appendix The Payment of the permit fee according to the price list in Appendix 6, according to the type of product 5. a notification regarding the sum to be paid will be sent after the approval of the application by the feed division In addition, the importer is requested to present to following documents, according to the type of product and the group to which it belongs. 7 3. Shipment test certificates for pesticide residues, mycotoxins and heavy metals comply to the shipment and to the Israeli standards (Appendixe 8 - Parts 1,2 and 3). Radioactive radiation test) for grains from Eastern Europe only (Appendix 8 part 4) Comments: Shipments must be free of quarantine pests, including seeds of noxious weeds, as specified in the plant import regulations: D-E18F-44A4-B71D- A249C73121B1/0/PlantImportRegulations2009Unoffi cialtranslation.pdf Regarding vegetable seeds, sunflower seeds and peanuts, plant import requirements published in the regulations or listed in the Plant Quarantine Service plant import license must be met. Import of nuts in shells, including peanuts, is forbidden. Group II Minor grains besides those mentioned in the previous section Requirements for issuance of annual permit 1. Permit request application, including statement signed by applicant for each grain source combination on application form, Appendix 2. (In case of raw grain mixes, specify all types of grains contained in the mix. 2. Statement signed by applicant regarding committing to AFO requirements. Import permit issuance requirements according to the Free Import Act: (Issued by the PPIS units at the ports for each product-source-supplier combination). 1. Animal Feed Division permit certificate based on AFO. 2. An origin certificate that testifies of the origin of the grains in the consignment. 3. Shipment certificate of analysis for aflatoxins conforming to requirements specified in the Israeli standard (Appendix 8 part 2). 8 Group III Plants, plant products and byproducts. By-products from flour mills, cakes, human food industry by-products and other plant by-products Annual permit issuance requirements 1. Permit request application including statement signed by the applicant for each product source-name of the producing factory combination on the application form, Appendix 2 2. If the product is a Processed plant, Factory's accreditation certificate for ISO 9001/2000 standard or similar (GMP, HACCP or equivalent) that meets the requirements of the country of manufacture, if exists. 3. In cases of importation of a plant submit the appropriate import permit from the Plant Protection and Inspection Services plant quarantine service or, in case of a vital seaweed, from the Ministry of Agriculture s Fishery Division. Requirements for issuance of an import permit issue according to the Free Import Act: (Issued by the PPIS units at the ports for each productsource-supplier combination). 1. Animal Feed Division permit certificate based on AFO. 2. A certificate of analysis of pesticides residues, mycotoxins and heavy metals, and complies with the Israeli standards, as specified in Appendixes 8 parts 1-3, for fresh plants. Group V vegetable oils and fats Annual permit issue requirements: 1. Submit permit request including declaration signed by applicant for each product source production plant combination on application form, Appendix Plant's accreditation certificate for ISO 9001/2000 standard or similar (GMP, HACCP or equivalent) accepted in the country of manufacture. 3. A certificate of analysis of dioxins and heavy metals their level is below the level permitted in Israel (Appendix 8 part 3 & 5). 9 Group V Milk replacers Annual permit issue requirements: 1. Permit request application, including statement signed by applicant for each product source production plant combination on application form, Appendix Veterinary import permit for animal products 3. Full list ingredients and their quantities (Certificate of composition). 4. Update Certificate of analysis for the nutritional values of each product. 5. An original product label, in English or translated into English by a notary public. 6. A Hebrew label, according to the requirements specified in Appendix 4. Marketing, medical or para-medical statements may not be placed on the label. 7. In Addition, For new milk replacers, a product dossier that includes the following: A. Production method B. Physical and chemical properties of the milk replacer. Stability in light, temperature, moisture, oxygen Stability in production process Stability in storage C. Tests providing milk replacer's efficiency for proposed use: Improvement of feed quality Improvements of animal product amount and quality D. Tests proving safety of use of milk replacer in animals E. List of countries in which the milk replacer has been permitted for use. * Dossier registration renewal will be performed every 5 years after the original registration date. 10 Group IV Animal products and by-products Rendering plant products, animal fats, dairy industry remains, microorganisms. Annual permit issue requirements 1. Permit request application, including statement signed by applicant for each product source production plant combination on application form, Appendix Veterinary import permit for animal products. 3. For animal fats, certificate of analysis of dioxins and heavy metal their level is below the level permitted in Israel (Appendix 8 Part 3 and 5). 4. For meals of animal origin, a certificate of analysis excluding the presence of proteins of mammals origin (Appendix 8 part 10) Import permit issue requirements according to the Free Import Act: (Issued by VS Units at the ports for each product-sourcesupplier combination). 1. Animal Feed Division permit certificate based on AFO. 2. Veterinary import permits for animal products. Before applying to the Animal Feed Division for a permit it is mandatory to obtain a Veterinary Import Permit. Permit request application for the manufacturing, marketing and trading in feed additives, including detailed information provided by the applicant for each additive, as specified in the permit application form, Appendix Manufacturing plant's accreditation certificate for ISO 9001/2000 standard or similar (GMP, HACCP or equivalent) that meets the requirements of the country of manufacture. 3. Certificate of Free Sale for the additive from the relevant authority in the country of production or a certificate attesting to government supervision over the product in the country it is produced in. 4. Submission of dossier according to terms specified in Section B of this document (the Dossier is not required for premixes). However, if the product dossier has been previously submitted and no changes have been made to the product, the dossier required by Section B is not required for the renewal of the permit certificate. Dossier registration renewal will be performed every 5 years after the original registration date. 5. A request for permission to manufacture, market and trade in animal feed products, including full details by the applicant for each type of food (medicated/nonmedicated), type of mix-animals for which the feed is intended, using permit application form (Appendix 2). 2. Plant's accreditation certificate for ISO 9001/2000 standard or similar (GMP, HACCP or equivalent) that meets the requirements of the country of manufacture. 3. Certificate of Free Sale for the product from relevant authority in the country of production. 4. Original label (in English or translated into English by a notary public). 5. Hebrew label for the mixes and statements of their content according to requirements specified in Appendix 6. 14 Group X One-time permits for animal feed issued for research purposes and lab tests 1. Statement regarding the purpose of the import. 1.1 Import for research purposes (including taste and viability tests) statement regarding study objectives and statement agreeing not to sell the food after testing. 1.2 Import for lab tests - statement regarding study objectives and statement agreeing not to sell the food after testing. 1.3 Maximum weight of the feed: for farm animals: 1000 kg; for other animals: 100 kg. 2. Invoice. 3. Full list of ingredients in the product and their quantities. 4. Veterinary import permit in cases of products containing animal components. Group XI Permits according to permit (permission to use a permit by other party) Annual permit issue requirements: 1. The importers must provide, enclosed to the application for the annual permit, a list of clients that are expected to obtain permission to use their permit during the upcoming year and a full list of products for each client. 2. The importer shall apply for a permit on behalf of the second party (feed mills / centers) and it shall be issued and sent to the importer who will be responsible to pass it to the second party. 3. In case of any problem with product the responsibility lies with the importer. The importer is must notify the Veterinary Services and the clients regarding any changes in the product. 4. Submission of request for registration of a feed additive for farm animals, Appendix The following documents must all be attached to the request form, as detailed in Group VI, Section C. 3. A product dossier as described below will be attached to the request: 3.1 Proposed name for additive, the requesting company's name, manufacturer's name and the place of production. 3.2 Type of additive according to its effect. A) Growth promoter, B) Preservative, C) Amino acid, D) Microorganism, E) Vitamin, F) Mineral, G) Antioxidant, H) Enzyme, I) Flavor, J) Homeopathic substance, K) Other technological additives (emulsifiers, stabilisers, thickeners, gelling agents, anticaking agents, substances for reduction of the contamination of feed by mycotoxins, silage additives) 3.3 Physical condition (active substance composition, other components, contamination). 3.4 Manufacturing process. 3.5 Specifications concerning active substance. A) Generic name (IUPAC) or other, CAS No. B) Formula, molecular weight C) If the active substance is a product of fermentation the attributes and quantities of the main components must be submitted. D) Degree of purity and list of contamination. E) Physical properties, melting and boiling points, disintegration temperature, vapor pressure, water solubility. 3.6 Physical and chemical properties of the additive (preparation). A) Light stability, temperature, moisture, oxygen. B) Stability during preparation of premixes and feedingstuffs (kibble stability, if relevant). These tests must include the following: A) Safety in use as an animal feed additive. B) Risks to consumer due to consumption of food containing additive remains in animal products. C) Risk from inhalation or cutaneous contact for people working with the concentrated substance (industry employees). D) Risk of pollution to the environment from products derived from the additive and excreted by animals A list of countries where use of this additive is certified (please include relevant certificates and labels, in English). Comments: Manufacturer/importer must submit all documents specified in this section as prior condition for the registration of a feed additive. However, if the product dossier has been previously submitted and no changes have been made in the product, the dossier is not required for renewal of the permit certificate.
